1. Introduction
These Terms & Conditions ("Terms") apply to all visitors to this website and to all clients who engage Simple Global Shipping ("we", "us", "our") for freight forwarding, customs clearance, warehousing or related logistics services ("Services"). By accessing this website or instructing us to provide Services, you agree to be bound by these Terms.
2. Definitions
- Client means any person or entity that requests or receives our Services.
- Goods means any cargo, consignment or items handled, transported, stored or cleared by us on the Client's behalf.
- Quotation means an estimate of charges provided by us for a specific shipment or service.
3. Scope of Services
We act as a freight forwarder and logistics provider, arranging the transport, clearance and storage of Goods by air, ocean and road. Where we engage carriers, airlines, shipping lines, hauliers or other third parties on your behalf, we do so as your agent, and such services are subject to the terms and conditions of those third parties.
4. Quotations & Pricing
Quotations are based on the information supplied by the Client at the time of enquiry and on prevailing rates, surcharges and exchange rates. Quotations are valid for the period stated and may be revised where cargo details differ from those provided, or where carrier rates, fuel, security or currency factors change. All prices are exclusive of VAT, duties and taxes unless expressly stated.
5. Client Obligations
The Client warrants that all information, descriptions, weights, dimensions and documentation provided are complete and accurate, and that the Client is authorised to give instructions in respect of the Goods. The Client is responsible for ensuring Goods are properly packed, labelled and presented for transport.
6. Dangerous & Prohibited Goods
The Client must declare any dangerous, hazardous, restricted or high-value Goods in advance and in writing, together with all information required for safe and lawful handling. We reserve the right to refuse, hold or dispose of any Goods that are undeclared, unlawful or that pose a risk to safety, property or the environment.
7. Customs & Compliance
Where we act as customs broker, we rely on the documentation and declarations supplied by the Client. The Client remains responsible for the accuracy of customs declarations and for payment of all duties, taxes and statutory charges. We are not liable for delays, penalties or seizures arising from incomplete, inaccurate or late information.
8. Liability
Our liability in respect of any claim is limited to the extent permitted by the applicable international conventions and the standard trading conditions of the relevant carriers. We are not liable for indirect, consequential or economic loss, including loss of profit, market or use. Claims must be notified to us in writing without delay and within the time limits prescribed by the relevant carrier or convention.
9. Insurance
Goods are not insured by us unless the Client requests cargo insurance in writing and we confirm cover in writing. Unless so arranged, the Client bears the risk of loss or damage to the Goods. We strongly recommend that Clients arrange adequate marine and cargo insurance for all shipments.
10. Payment Terms
Unless otherwise agreed in writing, invoices are payable within the period stated on the invoice. We reserve the right to charge interest on overdue amounts and to exercise a lien over Goods in our possession in respect of any sums owed by the Client.
11. Cancellations & Amendments
Where a booking is cancelled or amended after carrier capacity has been reserved or services have commenced, the Client may be liable for charges already incurred, including cancellation fees levied by third parties.
12. Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to weather, strikes, congestion, carrier failure, governmental action, conflict or other events of force majeure.
13. Website Use & Intellectual Property
The content of this website, including text, graphics, logos and images, is the property of Simple Global Shipping or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or exploit any part of the website without our prior written consent.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
15. Changes to These Terms
We may update these Terms from time to time. The version published on this website at the time you engage our Services applies to that engagement. Continued use of the website or our Services constitutes acceptance of the current Terms.
